As of May 23, 2003 dealers in the United States must be able to show that they have implemented their programs to Safeguard customer information, as required by the federal Gramm-Leach-Bliley Act and the Federal Trade Commissions implementing regulations. Part of each dealers program is to assure that a dealers service providers enter into agreements with dealers regarding the safeguarding of customer information.
This Letter of Agreement is entered into for the purpose of assisting your dealership to comply with the U.S. Safeguard requirements of the FTCs regulations.
The Power Information Network (PIN) agrees that contracts between PIN and automotive dealers constitute a service provider agreement between PIN and dealer subject to 313.13 of the regulations implementing the Gramm-Leach-Bliley Act, 15 U.S.C. 6801. PIN further agrees that it will, to the extent required by federal law, maintain the confidentiality of, and appropriately safeguard, your customer information as that term is defined in the federal Gramm-Leach-Bliley Act and the Federal Trade Commissions implementing regulations.
By signing below, you and we agree that a signed original, photocopied, or faxed copy of this Letter of Agreement shall be treated as an original for all purposes.
